Welcome to Kinetrix! These Terms and Conditions (“Terms”) govern your use of our website and purchase of products from Kinetrix Ltd (“we”, “us”, or “our”). By accessing our website or placing an order, you agree to these Terms.

ACCEPTANCE OF TERMS
By accessing or using our website www.kinetrixperforamance.com or www.kinetrixperforamance.co.nz, subscribing to a product plan, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.
ELIGIBILITY TO PURCHASE
You must be at least 18 years old to purchase products or use subscription services on our website. By placing an order, you confirm that you meet this requirement.
ORDERS & PAYMENTS
All prices are listed in New Zealand Dollars (NZD) and include GST (where applicable).
Orders are accepted once full payment is received.
We reserve the right to cancel or refuse any order for any reason (e.g., stock errors, suspected fraud, incorrect pricing).
Payment methods accepted: Visa, Mastercard, American Express, UnionPay debit cards, and UnionPay credit cards. We also accept Apple Pay, Google Pay, and Shop Pay.
SHIPPING & DELIVERY
Please refer to our Shipping Policy for details on delivery timeframes, costs, missed deliveries, and responsibilities for lost or redirected parcels. By placing an order, you agree to those terms.
RETURNS & REFUNDS
We want you to be satisfied with your purchase. If there’s an issue, please contact us at team@kinetrixperformance.com within 7 days of receiving your order.
Your rights under the Consumer Guarantees Act 1993 apply. We will provide a refund or replacement if the product is:
- Faulty
- Damaged on arrival
We do not offer refunds for:
- Change of mind (except for Subscribers’ 24-hour Change-of-Mind period)
- Incorrect address entered by the customer
- Failure to collect the parcel from the courier
Refunds are at Kinetrix's discretion and may be subject to deductions (e.g., for shipping or promotional value).

PRODUCTS & USAGE
All Kinetrix products are formulated and made in New Zealand under a certified National Programme 3 (NP3) to ensure quality, food safety, and compliance with New Zealand regulatory standards.
Our products are designed as sports nutrition food supplements and are not intended to diagnose, treat, cure, or prevent any disease.
Always read product labels and follow usage directions. Consult with a qualified health professional before use, especially if pregnant, nursing, taking medications, or managing a health condition.
Kinetrix Ltd is not responsible for any adverse effects resulting from the misuse or improper use of our products.
Allergen Notice:
Our products may contain or be processed in facilities that handle common allergens, including but not limited to dairy, soy, tree nuts, gluten, and honey. Always read the product label carefully before use.
If you have food allergies, intolerances, or sensitivities, consult a health professional before consuming.
Kinetrix Ltd is not liable for allergic reactions caused by undisclosed sensitivities or failure to read ingredient information.
Product Availability and Pricing
All products, pricing, and offers are subject to change without notice. We reserve the right to discontinue products, limit quantities, and update prices at any time. Orders are subject to availability.
SUBSCRIPTION TERMS
When you sign up for a Kinetrix Subscription Plan, you authorise recurring billing for the monthly frequency of your selected Plan to your nominated payment method.
Minimum commitment:
Subscription Plan requires a 3-month minimum commitment period. If the subscription is cancelled before the end of the required period, a cancellation fee will apply.
The cancellation fee will reflect the value of free products received and help prevent misuse of subscription promotional offers.
Cancellations:
All cancellations will be processed in accordance with our Order Cancellation Policy.
You may manage or cancel your subscription via your account or by contacting us at team@kinetrixperformance.com
Cancellations take effect at the end of the current billing period, provided the minimum term has been met.
“Change-of-mind” cancellations are accepted within the first 24 hours of subscribing, with no additional cancellation fees.
Kinetrix Ltd reserves the right to adjust subscription pricing or product availability. You will be notified in advance of any such changes.
Refunds are not issued for subscription orders that have already been processed.
SOCIAL MEDIA GIVEAWAY TERMS & CONDITIONS
Eligibility:
The giveaways are open to New Zealand residents only.
How to Enter:
To enter, participants must meet the giveaway requirements noted in the promotional post or its caption.
Prizes:
The number of winners and the prizes will be specified in the promotional post or its caption. Prizes are non-transferable and cannot be exchanged for cash or other items. Obtained discounts can’t be multiplied or combined with other discounts unless specifically mentioned otherwise.
Winner Selection:
Winners will be randomly chosen and announced via the official Kinetrix social media channels. Winners will be contacted directly via DM.
Timeframe:
The giveaway closes on the date specified in the promotional post or its caption. Entries submitted after the closing date will not be counted.
Scam Prevention:
Kinetrix will never ask for credit card information or personal financial details. All communication will come only from our official social accounts and official contacts.
General:
By entering, participants agree to these Terms & Conditions. Kinetrix reserves the right to amend, extend, or cancel the giveaway at any time if circumstances require.
PRIVACY & SECURITY
We respect your privacy. Your personal information will only be used in accordance with our Privacy Policy for order processing, managing subscriptions, providing customer support, communication, and improving your experience.
All payments, including recurring subscription charges, are securely processed through our third-party payment provider Shopify Payments.
Kinetrix does not store or have access to your full credit card details.
Our website uses SSL encryption and complies with standard data protection practices to keep your information safe.
INTELLECTUAL PROPERTY
All content on our website, including images, logos, branding, graphics, product descriptions, and website design, is the property of Kinetrix Ltd and protected by copyright and intellectual property laws.
You may not copy, reproduce, or use our content without our prior written consent.
THIRD-PARTY LINKS
Our site may contain links to external websites we do not control. We are not responsible for the content accuracy, or privacy practices of those sites.
WEBSITE USAGE
You agree not to use the Kinetrix website for:

- Violating any laws or regulations
We reserve the right to block access or cancel orders from users who violate these Terms.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Kinetrix Ltd is not liable for:
- Any indirect, incidental, or consequential damages
- Delays caused by third parties (couriers, customs)
- Loss resulting from misuse of the products
- Issues resulting from unauthorised changes to delivery via the courier’s tracking system
Our total liability is limited to the value of the product purchased.
Nothing in these Terms limits your rights under New Zealand consumer law.
GOVERNING LAW
These Terms are governed by the laws of New Zealand, and any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
ACCOUNT TERMINATION
We reserve the right to suspend or terminate accounts that violate our Terms or misuse our services.
FORCE MAJEURE
We are not responsible for delays or non-performance caused by events outside our control, including natural disasters, pandemics, courier disruptions, or internet outages.
CHANGES TO TERMS
We may update these Terms from time to time. Any changes will take effect immediately once published on our website.
Your continued use of the site or placing of orders means you accept the current version of the Terms.
